PARTICIPATION

1   The Promotion is open to residents of the United Kingdom aged 16 years or over only.

HOW TO ENTER

2   The Promotion works as follows:

     2.1   To enter, record a video or take a photo that shows us your love of Jaffa Cakes and tell us why you should be a member of the Cult of Jaffa or sit on the Cult of Jaffa Grand Council.  If your video or photo features  or was made with the assistance of any other person please read Terms 19 and 23 carefully;

     2.2   Upload your video or photo entry at www.cultofjaffa.co.uk, www.youtube.com/cultofjaffa or www.twitter.com/cultofjaffa;

     2.3   Applications for membership of the Cult of Jaffa must be submitted after the opening date of 1 June 2011, and before any closing date which is announced on the application pages in the future;

     2.4   Applications for membership of the Grand Council will be accepted for limited periods only, and may be submitted by existing members of the Cult of Jaffa or new applicants:

          (a)   The first round opens on 1 June 2011, and the closing date will be announced  on the applications pages;

          (b)   The opening and closing dates of subsequent rounds will be announced on the application pages; and

     2.5   We will give at least two weeks’ prior notice of any closing date.

3   Entries by email, post or facsimile will not be accepted.  The only way to enter is by uploading your entry to one of our websites as explained in Term 2.2 above.

4   Our panel of judges (which includes an independent judge) will look at all qualifying entries received and decide which entries best show their love of Jaffa Cakes in the most creative way and demonstrate that they have the qualities necessary to become a member of the Cult of Jaffa or sit on the Grand Council.  Such qualities may include communications skills, the innovative use of social media and the ability to dedicate time to any duties that may be assigned to them as Cult of Jaffa or Grand Council members.  It is up to our panel to decide who is admitted to sit on the Grand Council or as a member of the Cult of Jaffa.  In all cases, the panel’s decision is final and no correspondence will be entered into.

5   There is no limit to the number of Cult of Jaffa memberships available, but the number of Grand Council positions is currently limited as follows:

Grand Master: 1 Grand Council position
Social Jaffanistas (and deputies): 11 Grand Council positions
Jambassadors (and deputies): 11 Grand Council positions
Keepers of the Scrolls (and deputies): 11 Grand Council positions

6   We will let you know by email if you have been accepted as a member of the Cult of Jaffa or if you have been one of the lucky few chosen to sit on the Grand Council. If you do not accept the offer of membership to the Cult of Jaffa or the invitation to sit on the Grand Council in accordance with the instructions in your email notification, then we may invite an alternate applicant to the membership in your place.

7   We may operate additional promotions giving people the opportunity to become members of the Cult of Jaffa and its Grand Council in the future. We may also appoint additional people to any role or Grand Council position and create new roles or Grand Council positions as we see fit.  We may remove people from the Cult of Jaffa or any particular role or Grand Council position within it where they do not comply with these terms and conditions and any membership rules we may establish in the future.

8   No applications from third parties, or applications automatically generated by computer will be accepted. No incomplete or corrupted entries will be accepted. Entries not in accordance with the entry instructions will be rejected.

9   Videos/photos should be submitted by the person responsible for making the video/photos. Where more than one person is involved in making the video/photos, see Terms 19 and 23 below.

10   You can enter as many times as you like but an individual may not hold more than one membership of the Cult of Jaffa.

11   We do not accept responsibility for entries that are lost, damaged or delayed as a result of any network, computer hardware or software failure of any kind. Proof of uploading/sending will not be accepted as proof of receipt.

ROLES OF MEMBERS OF THE CULT OF JAFFA AND ITS GRAND COUNCIL

12   Those specially chosen individuals who have proved that they love Jaffa Cakes and are suitable to hold membership of the Cult of Jaffa or sit on its Grand Council will be expected to perform a variety of duties, which will develop over time.  Whilst there is no salary or other remuneration provided for Cult of Jaffa or Grand Council members, the positions are enviable since, in particular those who sit on the Grand Council, members will play an important part in shaping the Cult of Jaffa's activities throughout the Promotion.  Members will be eligible to perform tasks and challenges which will be notified to successful entrants by email during the Promotion.

13   Cult of Jaffa or Grand Council members will act as 'brand ambassadors' for Jaffa Cakes and will be expected to behave in a manner that befits positions of such high esteem at all times.  The name and photograph of Cult of Jaffa or Grand Council members may also feature in publicity for Jaffa Cakes along with your entries and any content (i.e. text, videos, photos, sound etc) that you subsequently upload or post during the Promotion (in these terms and conditions such content also constitutes an "entry").

14   The value of membership and/or Grand Council positions is nil, there is no cash alternative, and you may not sell or otherwise trade your status as a member or position on the Grand Council.

USAGE

15   By submitting or uploading your entry, you grant us a worldwide, non-exclusive, royalty-free, sub-licensable and transferable licence to use, reproduce, distribute, perform and make derivative works of your entry in any media and through any media channel, including the right to make your entry available for download.

16   Without limitation, entries may be shown on the Cult of Jaffa website, YouTube, Flickr and Facebook. In addition, entries may be shown on other United Biscuit websites or social media pages, affiliated blogs and other affiliated pages.

CONDITION OF ENTRIES

17   Each entry that you submit as part of your application to become a member of the Cult of Jaffa or to sit on its Grand Council, or subsequently at any time during the Promotion:

     (a)   must be suitable for display and publication online;

     (b)   should not be obscene or indecent (for example, but without limitation, it must not include nudity, pornography or profanity);

     (c)   must not contain defamatory statements or words or symbols that are offensive either generally or to individuals of a certain race, ethnicity, religion, sexual orientation or socioeconomic group;

     (d)   must not include threats to any person, place, business or group;

     (e)   must not breach confidence or invade privacy or other rights of any person, firm or entity;

     (f)   must not in any other way violate applicable laws and regulations or network standards or include content which is otherwise inappropriate or would cause annoyance or inconvenience;

     (g)   must not contain or refer to any products, trade marks or logos other than those of United Biscuits;

     (h)   must not contain any works in which someone other than the entrant owns the rights (including copyright).

18   Each entry shall be the entrant's own work. By entering the Promotion each entrant warrants that their entry shall be original and shall not have been previously published or exploited in any part and will not infringe any copyright, right of privacy, right of publicity or personality or any other right whatsoever of any third party.

19   If anyone other than you appears in your entry, you must have their permission to use their name and/or likeness in the manner contemplated by this Promotion.

20   We reserve the right to have entries received in connection with this Promotion reviewed by a third party moderator after they have been placed online to confirm they comply with these terms and conditions. If the moderator deems any such entries are or could reasonably be construed as being unlawful or contrary to these terms and conditions, we shall endeavour to remove them from the website immediately. The Promoter reserves the right, but is not obliged, to amend, delete or remove any published entries from the website and any other website where entries are published at any time, for any reason, without prior notice to entrants.  If you believe any entries may breach these terms, then please let us know by emailing info@cultofjaffa.com.

21   You must fully co-operate with us and any law enforcement authorities or court order requesting or directing us to disclose the identity of or locate anyone posting any material in breach of these terms.

22   In addition, since our websites may use technology embedded from youtube.com, twitter.com, flicker.com and facebook.com, you also agree to their Terms of Service available at www.youtube.com/t/terms, www.twitter.com/tos, http://info.yahoo.com/legal/uk/yahoo/utos-173.html and www.facebook.com/terms.php respectively. The Promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook or YouTube, and you acknowledge that neither has any liability to you in connection with this Promotion. YouTube, Facebook, or any other website operator may also remove content if they deem it to be inappropriate for use on their website. If this occurs to your entry it will be removed from the Promotion.

23   If any group of people elects to collaborate on a submission, they are required to designate one person as the agent of the group to enter the Promotion, and to agree to these terms and conditions.  Only the designated person will be granted membership of the Cult of Jaffa or appointed to its Grand Council unless we agree otherwise in our absolute discretion.

24   You, on behalf of yourself and any other person involved in contributing to your entry (as author, director, performer, or otherwise) agree that you (and any such contributor) will not assert any so-called moral rights (such as the right to have your name attributed to the entry).

25   If you submit an entry that includes material the rights in which are owned by a third party or otherwise infringes that third party’s rights, including intellectual property rights such as copyright and trademarks, you will be responsible for any legal action that party may take against you and for any losses, liabilities, claims, actions, proceedings, costs and expenses (including reasonable legal fees) which we, our affiliates, agents and employees may suffer as a result of a claim from that third party.

26   Those that have ticked, accepted and therefore chosen to take part in the Cult of Jaffa campaign T's&C's may be approached by email by an independent 3rd party, solely for the purposes of conducting private campaign research. Email addresses will not be used for any marketing purposes.

27   By entering the Promotion, all entrants will be deemed to have accepted and be bound by these terms and conditions and consent to the transfer of their personal data to us (and our marketing agents) for the purposes of the administration of this Promotion and any other purposes to which the entrant has consented. All entry instructions form part of the terms and conditions.

28   We may amend these terms and conditions at any time, if we do so we will notify you by email if you have already entered and we will post any changes on our website.

29   Please note that under the Contracts (Rights of Third Parties) Act 1999 these terms can be enforced against you by our partners, including our marketing agents, such as MEC Global.

30   These terms and conditions shall be governed by English law and the courts of England and Wales shall have exclusive jurisdiction.
